These Terms of Use (”Terms”) govern purchases you make on and your use of the The Label Shack web site, TheLabelShack.co.uk, available by desktop or mobile web, (the ”Site”) controlled by [The Label Shack] (”we”, ”us”, “TLS”).

“Client” means the business entity purchasing services from the Provider. “Provider” means [The Label Shack] (”we”, ”us”, “TLS”, the business entity providing services to the Client. “Services” means the services provided by the Provider to the Client as specified in the Order. 

We reserve the right to update or modify these Terms at any time without prior notice. For this reason, we encourage you to review the Terms before you make any purchase or whenever you otherwise use or access the Site. The date of the latest update is found in the final section of the Terms. If you do not agree to these Terms, please do not make any purchase or otherwise use or access the Site. Your purchase or use of the Site constitutes your agreement to follow and be bound by these Terms.

By accepting these Terms through your purchase or use of the Site, you certify that you are 18 years of age or older. If you are under the age of 18 but at least 13 years of age, you may use the Site or make a purchase only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

We do our best to ensure that information on the Site is complete, accurate and current. Despite our efforts, however, information on the Site may occasionally be inaccurate, incomplete or out of date. All products, descriptions and prices of products on the Site are subject to change at any time without notice.

After submitting your order, we will send you an order confirmation e-mail with your order number, details of the product you have ordered from us, your payment details and delivery details. We reserve the right to cancel the order throughout the whole manufacturing process if it should prove to be contrary to our Terms of Use. Full refund will be given if an order is cancelled.

Once your order has been processed, a shipping confirmation e-mail will be sent with all relevant information about your order. We recommend that you save the confirmations to facilitate any future contact with our customer service.

• Credit cards and debit cards 

Payment can be made by the following credit cards: American Express, China UnionPay (CUP), Discover & Diners Club, eftpos Australia, Japan Credit Bureau (JCB), Mastercard, Visa. Please note that your card is debited with the purchase amount once TLS has sent you the order confirmation email. All credit/debit card transactions on the Site are processed using Stripe, a secure online payment gateway that encrypts your card details in a secure host environment. Payment will be debited and cleared from your account upon acceptance of your order by TLS. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to TLS, your order will be cancelled. We are not responsible for any charges or penalties which may be imposed by the payment provider as result of payment being processed in respect of your order. 

• Pay Later with Klarna 

Pay Later is done in cooperation with Klarna and Klarna’s payment terms apply. If you choose to pay with Klarna – Pay Later, additional terms will apply between you and Klarna. These terms are presented to you via the Klarna agreement portal. 

• Pay Later with PayPal 

Pay Later is done in cooperation with PayPal and PayPal’s payment terms apply.  If you choose to pay with PayPal – Pay Later, additional terms will apply between you and PayPal. These terms are presented to you via the PayPal agreement portal. 

• PayPal 

When selecting the PayPal option, you will be directed to the PayPal site to ”Log In” and review the amount shown before clicking ”Pay Now”. Once this transaction is complete, you will then return to the Site. 

Delivery

We offer different shipping methods to meet your needs as further specified when you check out.

We reserve the right to charge a cost of £5 for uncollected packages that are returned from the shipping company to us, as well as packages that are returned due to incomplete or incorrect address from the customer as cover for shipping and handling costs.

Dispatch of orders may take up to 8 business days (Monday to Friday 9am to 5pm) but we aim to dispatch all orders within 2-3 business days during weekdays. Please note that delivery times are provided as guidelines only, and commence from the date of dispatch. The delivery times do not take into account possible delays caused by payment authorization and/or stock availability. If you need your purchase urgently, please contact us before placing your order so that we will have the opportunity to investigate whether we can deliver according to your wishes.

[Delays can also be caused by the artwork uploaded being in low resolution or otherwise unsuitable to print. We aim to handle communication efficiently to minimise such delays, but in these cases we are often dependent on new files being sent for production to commence.]

Price Promise
We are committed to offering competitive prices on our products. If you find a like-for-like price for labels within five days of purchase, we will match that price and refund the difference into your client account. Please note that we reserve the right to decline any price match request at our discretion.

You are entitled to return your purchase for a refund by submitting or sending notice thereof to TLS and postmarking/dispatching the product/s within 14 days of the date on which you have received the product, provided the product has not been materially used or worn. Should you have chosen to order a custom-made product, your right to return will expire when the production of your custom-made product has started.

If you would like to return a product, please login to your account, open the order you would like to return and select the Return button.

You as a customer will need to pay the shipping cost for returning the products for a refund.

If you receive defective products, please notify us within one day of the delivery. To notify us, please login to your account, open the order you wish to report and click the “Order Message” button. Please send us a message with a description of what happened, remember to take images and attach these to the message – if the labels have been damaged in transit, this will help us escalate any issues to our courrier. The product must be in the same condition as when you received it to enable us to approve a complaint, please take pictures of the box / packaging it came in. If TLS reasonably determines that the products are in fact defective, TLS will compensate you with a non-defective replacement or credit to your account.

TLS’s liabilities to you are limited in each separate case to these Terms unless otherwise is stipulated by law. TLS’s liabilities to you for any cause whatsoever will never exceed your total purchase amount for the order.

In no case whatsoever will TLS assume any liability for any incidental, consequential or indirect damages such as loss of profit or in case of force majeure such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters, epidemics, pandemics or similar events.

In order for us to fulfil your order we need to register, manage and store the personal information you provide to us.

Our processing of your personal data is collected and stored in accordance with applicable privacy laws, read more in our privacy policy.

We reserve the right to remove images or text that is illegal, offensive, obscene, racist or religiously offensive. We also reserve the right to refuse to print designs that we deem offensive.

By placing an order, you as a customer certify that you hold all rights regarding the use, publication and transmission of such data that has been transmitted, especially with regard to text and image material.

The Customer is solely responsible for ensuring that the product does not infringe anyone else’s intellectual property rights and that the content of the product does not otherwise violate applicable legislation.

The Customer agrees to without prejudice not hold TLS responsible for any claims that any third party may address to TLS in connection with infringement of third party rights, especially copyright, arising from the use of data transmitted from the customer, which means that the customer will ensure that TLS does not have to comply such requirements.

The Customer agrees to indemnify and hold us, our directors, officers, employees, agents, affiliates and subsidiaries harmless from and against any and all claims, damages, costs and expense, including attorney fees, arising from or related to infringement of third party rights, especially copyright, arising from the use of data transmitted from the customer, including text and image material.

Content Permission & Restrictions

Unless otherwise noted, the design of the Site, including the software, source code, text, images and all other content and materials that are part of the Site (collectively, ”Content”) are copyrights, trademarks or other intellectual properties owned, controlled or licensed by us. The Content is intended solely for your personal and non-commercial use. No right, title or interest in any Content is granted or transferred to you as a result of your use of the Site.

Except as noted herein, you may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, any of the Content or the Site. Your misuse of the Content is strictly prohibited and may subject you to liability under applicable laws.

By ordering and using the Site, you agree that TLS may, at its sole discretion, terminate your account and remove and discard any content that you may have contributed to the Site without prior notice.

You are responsible for the personal protection and security of any password or username that you may use to access the Site. You are responsible for all activity conducted on the Site that can be linked or traced back to your username or password. You are obligated to immediately report a lost or stolen password or username using our online form.

If you believe someone has used your password or account without your authorisation, you should complete our online form immediately. We reserve the right to access and disclose any information including, without limitation, user names of accounts and other information to comply with applicable laws and lawful government requests.

These Terms shall be governed by, construed and enforced in accordance with the laws of United Kingdom without giving effect to any principles of conflicts of law. In case any dispute arises in connection with these Terms, the dispute shall be subject to the courts having jurisdiction over TLS’s place of business, except in the case of a legal provision of mandatory law which stipulates otherwise.

If any part of these Terms is held to be invalid or unenforceable, such determination shall not invalidate any other provision of these Terms; instead the invalid terms and conditions shall be replaced with other terms in order to give effect to the commercial intentions of these Terms.
